Welcome to Modernized Ltd. These Terms and Conditions ("Terms") govern your use of our website and services. By accessing or using our services, you agree to comply with and be bound by these Terms. Please read them carefully before proceeding.

1. General Overview

1.1 Modernized Ltd provides painting, decorating, and related property services to homeowners, property management companies, and commercial clients. 1.2 By engaging our services, you agree to these Terms and any additional agreements signed between you and Modernized Ltd.

2. Services Offered

2.1 Modernized Ltd specializes in painting, decorating, property refurbishments, and maintenance services. 2.2 All services will be carried out professionally and in accordance with the details provided in the agreed estimate. 2.3 Any additional work outside the original scope will require a separate written agreement.

3. Estimates and Pricing

3.1 Estimates are provided based on the initial consultation and are valid for 30 days. 3.2 All estimates must be signed and returned to proceed with the work. 3.3 A deposit of 25% is required for projects under £5,000. For projects over £5,000, up to a 50% deposit may be required to cover materials and preparation costs. 3.4 Final payment (remaining balance) is due on the day of project completion unless otherwise agreed in writing.

4. Guarantees

4.1 All painting and decorating work is covered by a 12-month guarantee, subject to the following conditions:

• Damage caused by the client, third parties, or external factors (e.g., damp or structural issues) is not covered.

• The guarantee covers issues such as stains reappearing, unfinished paintwork, or other quality-related concerns. 4.2 Claims under the guarantee must be submitted in writing within the guarantee period.

5. Client Responsibilities

5.1 Clients are responsible for clearing rooms as much as possible before work begins. This includes removing furniture, accessories, and fragile items. 5.2 While Modernized Ltd provides protective coverings, liability for damage to items left in the workspace is limited. 5.3 Access to the property must be provided during agreed working hours.

6. Cancellations and Refunds

6.1 Cancellations made within 14 days of the project start date may result in forfeiture of the deposit. 6.2 Refunds for deposits will only be issued if cancellation occurs more than 14 days before the project start date. 6.3 Modernized Ltd reserves the right to reschedule or cancel work due to unforeseen circumstances, with advance notice provided where possible.

7. Liability

7.1 Modernized Ltd holds public liability insurance and ensures all work is carried out to the highest safety standards. 7.2 Modernized Ltd is not liable for:

• Delays caused by factors outside our control, such as weather or supply chain issues.

• Damage caused by pre-existing issues, such as damp or structural defects.

8. Privacy Policy

8.1 Modernized Ltd respects your privacy and complies with applicable data protection laws. Please refer to our Privacy Policy for details on how your data is handled.

9. Dispute Resolution

9.1 In the unlikely event of a dispute, Modernized Ltd will make every effort to resolve the issue amicably. 9.2 If a resolution cannot be reached, disputes may be referred to mediation or small claims court.

10. Governing Law

10.1 These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in England and Wales.
